Production Agreement

 

In order to book with us and use our services, you will need to fill out a production agreement that we will email over. Please find the terms of the agreement below.

Introduction

 

This is an agreement between The Casting Room Ltd and the production company.

 

The Casting Room is acting as an Employment Agency in accordance with the Employment Agencies Act 1973 and the conduct of Employment Agencies and Employment Businesses Regulations 2003.

 

Services

 

The Agency agrees to provide talent casting services to the Production Company for assignments as requested.

 

No bookings shall proceed without the Agency receiving a completed copy of this Agreement from the Production company with invoicing details filled in.

 

Compensation and Rates

 

Compensation for assignments under existing union agreements will be in accordance with the rates specified in the respective agreements. There are three primary union agreements commonly employed in and around the London area: FAA/PACT, BBC Equity, and ITV Equity.

 

Assignments not covered by union agreements will be compensated based on Agency rates or through negotiation between the Parties.

 

If the contribution of the Talent exceeds the initially agreed assignment, the talent may be entitled to an upgrade, and the fee will be adjusted accordingly. For example walk-on extra to featured extra.

 

Employment Status

 

Talent registered with the Agency are considered self- employed. They are responsible for their own tax and national insurance payments.

 

If Talent is contracted for longer periods, they may be considered PAYE employees of the Production Company. In such cases, the Agency’s commission will still need to be paid.

 

The Agency is responsible for ensuring all Talent has the right to work in the UK and will verify and retain copies of supporting documents as required.

Payment and Cancellations 

 

Payment for talent must be made directly into The Casting Room LTD business account.

 

The Production Company must not pay Talent directly. In case of direct payments, the Agency reserves the right to invoice the Production Company for the full amount.

 

A cancellation fee may be applicable based on the terms outlined in the union agreement or through negotiations between the Parties.

 

Late payments will be subject to a surcharge of 10%. Payments are deemed late after 30 days from the invoice date. Legal action will be taken to recover all unpaid invoices.

 

Data Protection

 

The Agency will provide certain personal data of their Talent to the Production Company. The Production Company agrees to safeguard this data and not share it with anyone outside their company.
